These Terms and Conditions (the "Terms") govern your access to and use of telefirstmed.com, its subdomains and landing pages, and any related online services (collectively, the "Services") operated by First Med PC, doing business as TeleFirst Med ("TeleFirst Med," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. The Services
TeleFirst Med offers online health evaluations and, where clinically appropriate, prescriptions for FDA-approved GLP-1 medications (such as semaglutide and tirzepatide) to eligible North Carolina residents. Care is delivered by clinicians affiliated with First Med PC. Medication, when prescribed, is dispensed by a licensed partner pharmacy.
The Services do not include compounded GLP-1 alternatives.
A consultation does not guarantee a prescription. Whether to prescribe is a clinical decision made by a licensed clinician based on their professional judgment.
2. Eligibility
You must meet all of the following to use the Services:
Be 18 years of age or older
Be a resident of North Carolina physically located in North Carolina at the time of consultation
Have the legal capacity to enter into a binding agreement
Provide accurate, current, and complete information
You are not eligible if any of the following apply (additional clinical exclusions may apply at the clinician's discretion):
Personal or family history of medullary thyroid cancer (MTC) or Multiple Endocrine Neoplasia syndrome type 2
History of pancreatitis
Currently pregnant, planning pregnancy, or breastfeeding
Known allergy or hypersensitivity to semaglutide, tirzepatide, or any inactive ingredients
History of diabetes (Type 1 or Type 2)
Submitting inaccurate or incomplete health information may delay or prevent treatment and may result in termination of your account.
3. Not for Emergencies
The Services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Do not use the Services to seek emergency care or report time-sensitive symptoms.
4. Medical Disclaimer
Information on the Services, including text, graphics, and images, is for general informational purposes and does not constitute medical advice. Medical advice is provided only through a clinical consultation conducted via the Services with a licensed clinician.
GLP-1 medications carry risks, including but not limited to nausea, vomiting, diarrhea, constipation, abdominal pain, gallbladder issues, kidney injury, allergic reactions, low blood sugar, and a boxed warning regarding thyroid C-cell tumors observed in animal studies. Discuss benefits and risks with your prescribing clinician. Read all medication-specific labeling before use.
Results vary. We make no guarantee that you will achieve any specific weight loss or health outcome.
5. Account Responsibility
You are responsible for:
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Promptly notifying us of any unauthorized use
You may not share your account, impersonate another person, or use the Services on behalf of someone else without authorization.
6. Payment, Billing, and Refunds
Fees for consultations, medications, and any subscription services are disclosed at the time of purchase. By providing payment information, you authorize us (and our payment processor) to charge the applicable fees.
Consultations: Generally non-refundable once a clinician has reviewed your submission.
Medication: Once shipped, medication is non-refundable, consistent with state and federal law governing dispensed prescriptions.
Subscriptions (if offered): Renew automatically until canceled. You may cancel future renewals at any time via your account or by contacting us. Cancellation is effective for upcoming billing periods; previously charged amounts are not refunded except as required by law.
If you believe a charge was made in error, contact [email protected] within 30 days.
7. SMS / Text Message Terms
By providing your mobile number and opting in, you agree to receive text messages from TeleFirst Med, which may include appointment reminders, prescription updates, follow-up care, account notifications, and (with your separate consent) marketing communications.
Message frequency varies.
Message and data rates may apply.
Reply STOP to opt out. Reply HELP for help.
Carriers are not liable for delayed or undelivered messages.

8. Permitted Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:
Provide false, inaccurate, or misleading health information
Resell, redistribute, or transfer any medication obtained through the Services
Attempt to access the Services on behalf of another person without authorization
Reverse engineer, scrape, or interfere with the Services or their security
Use the Services in any way that violates applicable law or regulation, including the Federal Food, Drug, and Cosmetic Act, the Controlled Substances Act, or state pharmacy and telehealth laws
9. Intellectual Property
The Services, including all content, software, design elements, logos, and trademarks, are owned by or licensed to First Med PC and are protected by U.S. and international intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. No other rights are granted.
10. Third-Party Services
The Services may rely on third-party providers (e.g., partner pharmacies, payment processors, hosting and communications providers). We are not responsible for the acts or omissions of third parties except as required by law or contract.
11. Disclaimers
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
NOTHING IN THIS SECTION DISCLAIMS THE PROFESSIONAL RESPONSIBILITY OWED BY A LICENSED CLINICIAN TO A PATIENT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIRST MED PC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR PROFESSIONAL NEGLIGENCE.
13. Indemnification
You agree to indemnify and hold harmless First Med PC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services, (b) your violation of these Terms, (c) your violation of applicable law, or (d) the inaccuracy or incompleteness of any information you provide.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you have violated these Terms, provided false information, or engaged in conduct that may harm us, our patients, or third parties. Provisions that by their nature should survive termination will survive (including Sections 9, 11, 12, 13, 15, and 16).
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles.
Informal resolution. Before filing any claim, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute for at least 30 days.
Venue. Any claim that cannot be resolved informally must be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction in those courts.
Class action waiver. To the fullest extent permitted by law, you and TeleFirst Med agree that disputes will be resolved on an individual basis and not as a class, collective, or representative action.
16. Changes to These Terms
We may update these Terms from time to time. We will revise the "Last Updated" date and, for material changes, provide additional notice. Continued use of the Services after the update constitutes acceptance of the revised Terms.
17. General
These Terms, together with the Privacy Policy and any other agreements you enter into with us, are the entire agreement between you and TeleFirst Med regarding the Services. If any provision is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them freely.
